All orders should be directed to the Customer Service Department
by mail, telephone or FAX. The Customer Service Department is open
weekdays (excluding national holidays) between the hours of 8:00
a.m. and 5:30 p.m. EST/EDT.
Terms
Net 30 days. Orders are normally shipped within 24 hours, FOB factory.

Product Usage and Storage
Usage: All products are packaged
and sold STERILE AND NON-PYROGENIC unless otherwise noted. Products
are sterilized with 100% Ethylene Oxide gas. Do not use any product
if its sterile package is damaged. Discard medical devices and accessories
after one procedure unless specified as reusable. Structural integrity
and/or function of products may be altered through cleaning and
reuse. Accordingly, Phoenix will not be responsible for any direct
or consequential damages or expenses resulting from reuse of nonreusable
medical devices and accessories. Prior to use refer to insert
sheet provided with each device for complete description and instructions
for use.
Storage: Store products
in a cool, dark, dry place. Do not expose to organic solvents.
Caution:
Federal (USA) law restricts these devices to use by or on the order
of a physician.
Warranty
Phoenix warrants that during manufacturing, packaging and sterilization,
care was taken to make the devices suitable for use as indicated.
Seller warrants that at the time of sale the goods shall be free
from defects in workmanship and material. The foregoing warranty
is in lieu of all other warranties, expressed or implied, and no
other warranties exist including, without limitation, any warranty
of merchantability or fitness for any purpose other than that designated
on the product insert sheet. Whether or not the device is appropriated
for use in a particular patient depends on the nature of the patient’s
signs and symptoms, and such determination is solely the responsibility
of the physician. If the goods do not conform to the warranty set
forth herein, seller’s sold liability and obligation shall be to
replace the goods or refund the purchase price.
Disclaimer of Warranty
There is no express or implied warranty, including any implied warranty
of merchantability or fitness for a particular purpose, of Phoenix
products, including the products described in this publication.
Under no circumstances shall Phoenix be liable for any direct, incidental,
or consequential damages other than expressly provided by specific
law. No person has the authority to bind Phoenix to any representation
or warranty except as specifically set forth herein. Descriptions
or specifications in Phoenix printed matter, including this publication
are written for the sole purpose to generally describe the product
at the time of manufacture and not to constitute any express warranties.

Product Return Policy
Before a Phoenix product can be returned for credit consideration,
approval for the return must be obtained after which an authorization
number will be issued and must accompany the returned product. Authorization
